CafeBiz News: The case of two plastic companies sharing from “Binh Minh”: Viet Sunrise Plastic JSC recognized
Viet Sunrise Plastic JSC has just been granted a trademark certificate, after two courts determined there was no infringement of intellectual property rights. According to information from CafeBiz.vn<\/strong><\/p>
The Intellectual Property Office (Ministry of Science and Technology) has just issued Decision No. 203462, recognizing the intellectual property rights and granting trademark registration certificate No. 570005 to Viet Sunrise Plastic JSC, based on the application submitted on November 28, 2022.
This move concludes a controversial legal journey between Viet Sunrise Plastic JSC and Binh Minh Plastic JSC.
Previously, after submitting the application for this certificate, Viet Sunrise Plastic JSC was sued by Binh Minh Plastic JSC over an intellectual property rights dispute.

In the first-instance judgment on July 12, 2024, the People’s Court of Ho Chi Minh City stated that the logos of the plaintiff and defendant do not overlap and are not similar; the company names are clearly displayed and easily distinguishable. Therefore, there is no basis to assert that Viet Sunrise Plastic JSC infringed upon the intellectual property rights of Binh Minh Plastic JSC. The court dismissed all claims of the plaintiff.
By April 2025, the High People’s Court in Ho Chi Minh City reviewed the appeal and upheld the first-instance judgment. The panel of judges noted that the logos and labels printed on the plastic pipes of the plaintiff and defendant are completely different, not overlapping, thus not violating point c of clause 1 of Article 129 of the Intellectual Property Law. Both parties’ logos and labels printed on the plastic pipes have the sign “BÌNH MINH” but the logos and printed labels in terms of font size and product origin are completely different, not causing confusion for consumers.
